TERMS OF SERVICE AND TERMS OF SALE
Effective Date: September 11, 2026
These Terms of Service and Terms of Sale (“Terms”) govern your use of statelessbooks.com and any purchase you make directly from Stateless Books LLC through this website.
Stateless Books LLC (“Stateless Books,” “we,” “us,” or “our”) is a Florida limited liability company.
These are the terms on which we offer our website, books, products, accounts, and direct sales.
They are not an invitation to negotiate.
If you do not agree with these Terms, do not use the site and do not purchase from Stateless Books.
By affirmatively accepting these Terms, creating an account, submitting an order, or completing a purchase, you agree to them.
1. WHO WE ARE
Stateless Books LLC
108 N Depot Dr.
Fort Pierce, FL 34950
United States
Email: support@statelessbooks.com
2. VOLUNTARY ASSOCIATION
Stateless Books operates on a simple principle:
We tell you the terms on which we are willing to do business. You decide whether you want to do business with us.
Nobody is required to visit this website.
Nobody is required to buy our books.
Nobody is required to agree with what we publish.
If our products, policies, ideas, prices, or terms are unacceptable to you, do not enter into the transaction.
By the same principle, Stateless Books is not obligated to transact with every person who wants to purchase from us.
We reserve the right to refuse service, reject an order, cancel a transaction, terminate an account, or decline future business at our discretion, subject to obligations we have voluntarily accepted and applicable Florida and United States law.
3. AGREEMENT TO THESE TERMS
When the website presents these Terms to you as part of checkout or another electronic transaction, your affirmative acceptance constitutes your agreement to these Terms.
You are responsible for reading them before accepting them.
Choosing not to read an agreement does not mean you did not agree to it.
If you do not understand or accept these Terms, do not complete the transaction.
The version of these Terms in effect when you place an order governs that transaction unless we expressly agree otherwise.
Special terms stated on a particular product page, preorder page, promotion, or offer also form part of the transaction.
If a product-specific term directly conflicts with a general provision of these Terms, the more specific product term controls for that transaction.
4. ELIGIBILITY AND AUTHORITY
You may use the website if you are capable of entering into the transaction you are attempting to make.
If you make a purchase on behalf of a company, organization, household member, or another person, you represent that you are authorized to make that transaction and provide the information used to complete it.
You may not impersonate another person, use payment credentials you are not authorized to use, or knowingly provide false transaction information.
5. CUSTOMER ACCOUNTS
Stateless Books may provide customers with an account for viewing orders and related information.
Accounts are provided as a convenience connected with the customer relationship.
You are responsible for:
keeping your login credentials secure;
restricting unauthorized access to your account;
providing accurate account information; and
notifying us if you reasonably believe your account has been compromised.
Stateless Books may suspend, restrict, or terminate an account when we reasonably believe doing so is appropriate for security, fraud prevention, abuse prevention, violation of these Terms, or protection of the business.
Customer accounts are not public profiles.
Stateless Books does not currently operate public reviews, discussion boards, customer forums, or social-posting features on the site.
6. ORDERS ARE SUBJECT TO ACCEPTANCE
Submitting an order does not remove our right to reject or cancel it.
An automated order acknowledgment merely means that our system received the order.
We may reject or cancel an order for reasons including:
product availability;
inventory errors;
pricing errors;
payment problems;
suspected fraud;
suspected misuse;
incorrect product information;
duplicate orders;
technical problems;
shipping restrictions;
jurisdictional concerns;
abuse of Stateless Books or its systems;
violation of these Terms; or
any other reason for which we choose not to complete the transaction.
If we cancel an order that we have charged but have not fulfilled, we may refund the amount collected for the cancelled item or order.
A refund initiated because we cancelled an order does not alter the general rule that customer purchases are final.
7. ALL SALES ARE FINAL
ALL SALES ARE FINAL.
Once you submit and complete a purchase, you should assume that it cannot be cancelled, returned, exchanged, or refunded.
We do not operate a “changed my mind” return program.
We do not provide refunds because:
you changed your mind;
you no longer want the product;
you failed to read the description;
you disagree with the book after reading it;
you found the product cheaper elsewhere;
you ordered the wrong item;
you dislike the content;
you expected something that was not promised;
you failed to read these Terms;
your circumstances changed; or
you simply decide you would prefer your money back.
Do not purchase something from Stateless Books unless you intend to keep the purchase.
8. DAMAGED, DEFECTIVE, MISSING, OR INCORRECT ORDERS
If you believe an item arrived damaged, defective, incomplete, or materially different from what you ordered, contact us at:
support@statelessbooks.com
Provide enough information for us to identify the order and understand the problem.
We may request photographs or other reasonable documentation.
These situations are handled case by case.
Depending upon the circumstances, Stateless Books may choose to:
replace the item;
send a missing item;
provide a partial refund;
provide a full refund;
provide another remedy;
assist with a carrier claim; or
determine that no remedy is appropriate.
The existence of a problem does not automatically create a right to a particular remedy.
Stateless Books determines the appropriate response based upon the circumstances of the order.
9. LIMITED, NUMBERED, SIGNED, AND PERSONALIZED EDITIONS
Signed, numbered, personalized, custom, limited-edition, special-edition, and similar products are final sale.
These products may be produced, signed, numbered, personalized, allocated, or prepared specifically in connection with the order.
Unless a product page expressly guarantees a particular copy number, Stateless Books determines numbering and allocation.
A request for a particular number does not guarantee that number unless we expressly agree to it.
Minor variations inherent in printing, binding, paper, ink, signatures, hand-numbering, packaging, or production do not automatically make a book defective.
A hand-signed or hand-numbered product is expected to contain natural variation.
10. PREORDERS
A preorder is a purchase of a product before ordinary fulfillment begins.
Unless otherwise stated on the product page, a preorder may be charged when the order is placed.
Any production date, printing date, publication date, fulfillment date, or shipping date given for a preorder is an estimate, not a guarantee.
Publishing and physical production can be affected by:
printers;
binders;
manufacturers;
suppliers;
freight;
material availability;
production problems;
author or publisher changes;
carrier delays;
customs;
weather;
force majeure events; and
other circumstances outside the original schedule.
By purchasing a preorder, you acknowledge that delays are possible.
A delay does not automatically create a right to cancel or receive a refund.
Preorders remain subject to our all sales final policy.
If Stateless Books itself ultimately cancels a preorder rather than fulfilling it, we may refund the amount paid for the cancelled product.
11. PRICES
Prices are shown in the currency displayed by the website.
We may change prices at any time before an order is completed.
A later price change does not entitle a prior purchaser to a refund or price adjustment.
Likewise, a prior lower price does not require us to offer that price again.
We reserve the right to correct obvious pricing, listing, calculation, or technical errors.
If we identify a material pricing error after an order is submitted, we may cancel and refund the order rather than fulfill it at the erroneous price.
12. PAYMENT
Payments are processed through Stripe and related payment infrastructure.
By submitting a payment method, you represent that you are authorized to use it and authorize the applicable transaction.
Stateless Books does not receive or store your complete payment-card number.
Payment processing may be subject to Stripe’s own terms and systems.
A payment authorization or successful charge does not eliminate our right to subsequently cancel and refund an order as permitted by these Terms.
13. SHIPPING
You are responsible for providing a complete and accurate shipping address.
We may use Shippo, the United States Postal Service, international postal services, commercial carriers, and other delivery providers.
Shipping dates and delivery dates are estimates unless we expressly state otherwise.
Once a shipment has been delivered to the carrier, risk of loss passes to the customer.
The carrier is responsible for the package while it moves through the carrier’s system.
Stateless Books is not an insurer of the postal system.
We may voluntarily assist with a lost or damaged shipment, carrier investigation, replacement, or claim, but doing so does not alter the general allocation of shipping risk stated in these Terms.
14. INCORRECT SHIPPING INFORMATION
You are responsible for confirming that your shipping address is accurate before completing the order.
Stateless Books is not responsible for loss, delay, misdelivery, or return caused by an address supplied incorrectly by the customer.
If an order is returned because of:
an incorrect address;
an incomplete address;
refusal of delivery;
failure to collect the package;
unpaid customs charges;
unavailable recipient; or
another circumstance attributable to the customer,
we may, at our discretion, offer to reship the order.
Additional shipping charges may be required.
A returned package does not automatically entitle the customer to a refund.
15. INTERNATIONAL ORDERS
Stateless Books sells books internationally.
If you order from outside the United States, you are responsible for understanding the conditions imposed upon you by the jurisdiction in which you choose to receive the product.
You are responsible for:
customs duties;
VAT;
import taxes;
brokerage charges;
postal fees;
handling fees;
customs-clearance charges;
local assessments; and
other charges imposed in connection with importing or receiving the shipment.
These charges are not the responsibility of Stateless Books unless we expressly state otherwise.
You are also responsible for determining whether your jurisdiction permits you to:
access the site;
purchase the material;
import the material;
possess the material; or
receive the material.
Stateless Books does not undertake to research the laws of every government on Earth before selling a book.
16. CUSTOMS, CENSORSHIP, AND GOVERNMENT INTERFERENCE
Books cross borders.
Governments sometimes interfere with books.
If a government, customs authority, postal agency, carrier, network provider, Internet provider, payment provider, or other institution:
delays a shipment;
rejects a shipment;
confiscates a shipment;
censors a publication;
blocks our website;
blocks a transaction;
prevents delivery;
imposes a tax;
requires a permit;
prohibits possession;
prevents importation; or
otherwise interferes with a transaction,
that action is not the responsibility of Stateless Books.
Once risk of loss has passed to the carrier as provided in these Terms, government seizure, customs refusal, or similar interference does not automatically create a right to a refund.
If your government does not want you to buy our books, that is a matter between you and your government.
17. CHARGEBACKS AND PAYMENT DISPUTES
A chargeback is not a substitute for our return policy.
If you have a legitimate problem with an order, contact us first so that we have an opportunity to review it.
Knowingly filing a false, dishonest, abusive, or improper chargeback is a material breach of these Terms.
Examples include disputing a legitimate charge because:
you changed your mind;
you forgot that you placed the order;
you disagree with our final-sale policy;
you do not want to pay for a completed purchase;
a preorder has not yet shipped within an estimated timeframe;
you received the product but want to retain both the product and the money; or
you knowingly misrepresent the circumstances of the transaction to a payment provider.
If an improper chargeback is filed, Stateless Books may:
provide transaction records to the payment provider;
contest the chargeback;
suspend or terminate your account;
refuse future orders;
preserve records concerning the dispute;
seek recovery of amounts legitimately owed;
recover reasonable collection costs where permitted; and
pursue other remedies available to us.
Nothing in this section prohibits a good-faith payment dispute concerning an actually unauthorized transaction or other legitimate payment issue.
18. REFUSAL OF SERVICE
Stateless Books is a voluntary business relationship.
We reserve the right to refuse service or future business where we choose not to continue that relationship.
Reasons may include:
fraud;
abuse;
threats;
harassment;
misuse of our systems;
violation of these Terms;
repeated improper chargebacks;
attempts to circumvent purchasing restrictions;
intellectual-property violations;
security concerns;
jurisdictional issues; or
other circumstances in which we determine that we do not want to transact.
Where an accepted order has already been paid but we choose not to fulfill it, we may cancel and refund the unfulfilled order.
19. PUBLICATIONS, IDEAS, AND OPINIONS
Stateless Books publishes books containing ideas.
Those ideas may be political, philosophical, economic, religious, historical, social, controversial, unpopular, provocative, or offensive to some people.
The publication of an idea does not create a professional advisory relationship.
Unless explicitly stated otherwise, Stateless Books publications and website content are provided for informational, literary, philosophical, educational, artistic, or expressive purposes.
They are not individualized:
legal advice;
financial advice;
investment advice;
tax advice;
medical advice;
psychological advice; or
other professional advice.
You are responsible for deciding what you think about what you read.
The purchase of a book does not mean that the purchaser agrees with the author, and the publication of an argument does not require the reader to accept it.
20. INTELLECTUAL PROPERTY
The Stateless Books website and its original contents are protected by applicable intellectual-property rights.
Unless otherwise identified, this includes material such as:
text;
copy;
book descriptions;
essays;
graphics;
illustrations;
artwork;
photographs;
layouts;
designs;
logos;
trademarks;
trade dress;
branding;
downloadable materials;
page designs;
product imagery; and
other original content.
Purchasing a physical or digital copy of a book does not transfer the copyright in the work.
You receive the copy you purchased.
You do not receive ownership of Stateless Books’ copyrights, trademarks, branding, source materials, or other intellectual property.
Ordinary linking to publicly available pages is permitted.
Nothing in these Terms is intended to eliminate uses that are independently permitted under applicable United States law.
21. NO UNAUTHORIZED COPYING OR REPUBLICATION
Except where we expressly authorize it or applicable United States law independently permits it, you may not:
reproduce our books;
republish substantial portions of our website;
distribute unauthorized digital copies;
sell unauthorized reproductions;
remove copyright or attribution notices;
falsely claim our work as your own;
create counterfeit editions;
commercially exploit our protected content;
copy our website for use by another business; or
use our intellectual property in a manner likely to create false affiliation or endorsement.
Permission requests may be sent to:
support@statelessbooks.com
22. SCRAPING, DATASETS, AND AI TRAINING
Access to a publicly reachable webpage is not permission to extract our content for every possible purpose.
Without our prior written permission, you may not use automated or systematic means to:
scrape substantial portions of the site;
bulk-download our content;
build a commercial database from our content;
create datasets from our books or website;
ingest our protected content into training datasets;
train, fine-tune, adapt, or evaluate artificial-intelligence or machine-learning models using our protected content;
create embeddings or similar persistent machine-readable representations of substantial protected content for commercial reuse;
circumvent technical measures intended to limit automated access; or
operate automated systems that impose unreasonable load on the site.
Ordinary indexing by conventional public search engines for the purpose of helping users locate publicly accessible webpages is permitted unless we communicate otherwise through technical or written instructions.
Permission to crawl for search indexing is not permission to use our content for AI model training or dataset construction.
23. PROHIBITED USE OF THE WEBSITE
You may not use statelessbooks.com to:
commit fraud;
attempt unauthorized access;
interfere with website operation;
introduce malware;
probe or exploit security vulnerabilities;
impersonate another person;
use stolen payment credentials;
interfere with another customer’s account;
circumvent access controls;
overload our infrastructure;
automate abusive requests;
harvest customer information;
violate our intellectual-property rights; or
facilitate unlawful attacks against Stateless Books or its systems.
We may block or restrict access when we believe a user, address, automated system, or network presents a security or abuse risk.
24. FOUNDERS EDITION AND MATERIAL SUBMITTED FOR PUBLICATION
Certain Stateless Books products may allow a purchaser to submit material specifically for publication.
The Founders Edition of The Blueprint for a Stateless Society is one example.
A Founder may submit a name, statement, line of text, or similar material for inclusion in the Founders Appendix.
By submitting material for publication, you represent that:
you have the right to submit it;
its publication does not knowingly violate another person’s intellectual-property or other legal rights; and
you understand that you are asking Stateless Books to make the material public.
You grant Stateless Books a perpetual, worldwide, royalty-free license to reproduce, print, publish, distribute, display, archive, format, and include the submitted material in connection with the applicable publication and its editions.
That license includes publication in:
the Founders Edition;
future hardcover editions;
future softcover editions;
digital editions;
archival editions;
electronic copies;
historical records concerning the publication; and
successor formats of the work.
This permission survives the original purchase and survives termination of a customer account.
Stateless Books may reject submitted material.
Purchasing a Founder position does not require us to publish material that we determine is inappropriate for the publication, infringes another person’s rights, creates an unreasonable legal risk, is technically unsuitable, or is otherwise something we decline to print.
Where practical, we may permit a replacement submission.
Once submitted material has been incorporated into a printed, distributed, archived, or downloaded edition, it may be impossible to remove it from copies already in existence.
A printed book cannot be recalled from reality because its contributor later changes their mind.
If you do not want something permanently associated with the publication, do not submit it for publication.
25. WARRANTIES REGARDING SUBMITTED MATERIAL
If you provide text, artwork, photographs, names, quotations, or other material to Stateless Books for publication or another requested use, you are responsible for having the right to provide it.
You agree not to knowingly submit material that:
infringes another person’s copyright;
infringes another person’s trademark;
falsely impersonates another person;
violates another person’s rights in a manner for which you lack authorization; or
contains malicious code or technically harmful material.
You remain responsible for claims arising from material you supplied to us and represented that we could use.
26. PRIVACY
Our collection and use of personal information is described in the Stateless Books Privacy Policy.
That Privacy Policy is incorporated into these Terms by reference.
If you do not agree with our Privacy Policy, do not use the site or purchase from us.
Information submitted specifically for publication is treated differently from private customer information, as explained in both documents.
27. ELECTRONIC COMMUNICATIONS
By transacting with Stateless Books electronically, you agree that the transaction may be conducted using electronic records and communications.
Communications may include:
order confirmations;
receipts;
account communications;
shipping notices;
policy notices;
customer-service responses; and
other records relating to your transaction.
You are responsible for providing an email address that you can access.
You should retain copies of transaction records that are important to you.
28. WEBSITE AVAILABILITY
We do not guarantee that statelessbooks.com will operate continuously or without interruption.
The website may occasionally be:
unavailable;
slow;
under maintenance;
affected by hosting problems;
affected by network failures;
affected by attacks;
modified;
redesigned; or
partially disabled.
We may add, remove, modify, or discontinue website functionality at any time.
29. PRODUCT INFORMATION
We try to describe products accurately.
However, photographs, displays, screens, printers, manufacturing processes, and physical production can create minor differences in:
color;
dimensions;
appearance;
texture;
paper;
binding;
packaging;
positioning;
signature appearance; or
other physical characteristics.
Unless a difference is material to what was actually promised, ordinary production variation does not make a product defective.
30. DISCLAIMER OF WARRANTIES
TO THE MAXIMUM EXTENT PERMITTED UNDER THE FLORIDA AND UNITED STATES LAW APPLICABLE TO STATELESS BOOKS, THE WEBSITE, ITS CONTENT, AND PRODUCTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS EXCEPT FOR ANY EXPRESS PROMISE WE SPECIFICALLY MAKE IN WRITING.
STATELESS BOOKS DISCLAIMS IMPLIED WARRANTIES TO THE MAXIMUM EXTENT THEY MAY LAWFULLY BE DISCLAIMED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
WE DO NOT WARRANT THAT:
THE WEBSITE WILL ALWAYS BE AVAILABLE;
THE WEBSITE WILL BE ERROR-FREE;
EVERY TYPOGRAPHICAL ERROR WILL BE ABSENT;
A BOOK WILL MEET YOUR PERSONAL EXPECTATIONS;
YOU WILL AGREE WITH A BOOK;
INFORMATION WILL REMAIN CURRENT FOREVER; OR
A THIRD-PARTY CARRIER, PAYMENT PROVIDER, NETWORK, CUSTOMS AUTHORITY, OR OTHER OUTSIDE SYSTEM WILL OPERATE WITHOUT INTERRUPTION OR ERROR.
Nothing in these Terms creates a warranty that we have not expressly made.
31. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY THE FLORIDA AND UNITED STATES LAW APPLICABLE TO STATELESS BOOKS, STATELESS BOOKS LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO:
USE OF THE WEBSITE;
INABILITY TO USE THE WEBSITE;
A PURCHASE;
A PRODUCT;
SHIPPING;
DELAY;
LOST DATA;
LOST PROFITS;
THIRD-PARTY SERVICES;
GOVERNMENT ACTION;
CUSTOMS ACTION;
CARRIER ACTION;
PAYMENT-SYSTEM ACTION; OR
CONTENT OF A PUBLICATION.
TO THE MAXIMUM EXTENT PERMITTED BY SUCH LAW, THE TOTAL AGGREGATE LIABILITY OF STATELESS BOOKS ARISING FROM A PARTICULAR ORDER WILL NOT EXCEED THE AMOUNT ACTUALLY PAID TO STATELESS BOOKS FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM.
If you paid $250 for the order giving rise to the dispute, our contractual liability arising from that order is therefore capped at $250 to the maximum extent permitted under the governing law agreed to in these Terms.
32. INDEMNIFICATION
You agree to indemnify and hold harmless Stateless Books LLC and its owners, officers, employees, contractors, and agents from third-party claims, liabilities, losses, damages, and reasonable expenses arising from:
your fraudulent use of the website;
your violation of these Terms;
material you submit to us for publication;
your infringement of another person’s rights;
your unauthorized use of our intellectual property;
your misuse of another person’s payment information; or
unlawful conduct undertaken through your account or at your direction.
This section does not require you to indemnify Stateless Books for a claim caused solely by Stateless Books’ own conduct where such an obligation would be prohibited under the governing law.
33. JURISDICTION AND VOLUNTARY ASSOCIATION
Stateless Books LLC is a Florida company operating from Florida, United States.
We voluntarily conduct our business under the laws and obligations we have accepted in Florida and the United States.
We do not voluntarily submit Stateless Books to the laws, regulatory systems, administrative agencies, or claimed jurisdiction of every government from whose territory a person may reach our website.
The Internet crosses political borders.
Your unilateral decision to access a Florida business’s website from another jurisdiction does not constitute our voluntary agreement to the political authority of that jurisdiction.
Likewise, your decision to purchase one of our books does not create our consent to additional legal or regulatory terms that we have not accepted.
If the laws imposed upon you by your jurisdiction conflict with the conditions under which Stateless Books is willing to transact:
DO NOT PURCHASE FROM US.
If your jurisdiction claims to provide you with a non-waivable right, remedy, regulatory entitlement, or condition that materially conflicts with these Terms, and Stateless Books is unwilling to accept that condition, then there should be no transaction between us.
We are not asking you to agree that your government lacks power over you.
We are telling you the terms on which we are willing to associate with you.
If we know that completing a transaction would require Stateless Books to knowingly accept obligations or jurisdiction to which we have not agreed, we reserve the right to refuse or cancel that transaction.
The technical ability of our website to receive an order from a location does not constitute voluntary political or jurisdictional consent.
The ability of an international carrier to deliver one of our books into a territory does not constitute our voluntary submission to every government through whose territory that book travels.
34. GOVERNING LAW
These Terms and transactions with Stateless Books are governed by the laws of the State of Florida and applicable law of the United States, without regard to conflict-of-law principles that would require application of another jurisdiction’s laws.
The parties select Florida law as the law governing their voluntary contractual relationship.
35. EXCLUSIVE FORUM AND VENUE
Any lawsuit, action, or proceeding arising from or relating to:
these Terms;
the website;
a Stateless Books account;
a purchase;
a product;
a preorder;
a publication submission; or
the relationship between you and Stateless Books
must be brought exclusively in an appropriate state court located in St. Lucie County, Florida, or, where federal subject-matter jurisdiction exists, in the United States District Court having jurisdiction over St. Lucie County, Florida.
By entering into a transaction with Stateless Books, you consent to personal jurisdiction and venue in those courts for disputes between you and Stateless Books.
Stateless Books does not agree to litigation in a foreign court merely because you chose to access our website from another jurisdiction.
36. WAIVER OF JURY TRIAL
TO THE MAXIMUM EXTENT PERMITTED BY THE GOVERNING LAW, YOU AND STATELESS BOOKS EACH KNOWINGLY AND VOLUNTARILY WAIVE THE RIGHT TO A TRIAL BY JURY IN ANY DISPUTE ARISING FROM OR RELATING TO THESE TERMS, THE WEBSITE, OR A TRANSACTION WITH STATELESS BOOKS.
Any dispute that proceeds in court will therefore be decided by the court rather than a jury to the extent this waiver is enforceable.
37. INDIVIDUAL CLAIMS — NO CLASS ACTIONS
TO THE MAXIMUM EXTENT PERMITTED BY THE GOVERNING LAW, CLAIMS BETWEEN YOU AND STATELESS BOOKS MUST BE BROUGHT ON AN INDIVIDUAL BASIS.
Neither party agrees to participate in a dispute as a:
class action;
collective action;
consolidated representative action;
private-attorney-general action; or
other proceeding brought on behalf of persons who are not individually parties to the dispute,
except where the governing law does not permit that limitation.
You may pursue your own claim.
You do not receive authority through these Terms to pursue somebody else’s.
38. NO IMPLIED WAIVER
If Stateless Books chooses not to enforce a provision of these Terms on one occasion, that does not mean we permanently waive the provision.
A voluntary refund, replacement, accommodation, exception, favor, or customer-service decision in one situation does not create a policy requiring us to do the same thing in another situation.
An exception is an exception.
It does not rewrite the agreement.
39. SEVERABILITY
If a court having jurisdiction over Stateless Books determines that a particular provision of these Terms cannot be enforced, that provision should be enforced to the maximum extent the court determines permissible.
If it cannot be enforced at all, it should be severed to the minimum extent necessary.
The remainder of these Terms remains in effect.
A disagreement concerning one provision does not automatically invalidate the entire agreement.
40. FORCE MAJEURE
Stateless Books is not responsible for delay or failure caused by circumstances reasonably outside our control.
Examples may include:
natural disasters;
hurricanes;
floods;
fires;
severe weather;
war;
civil unrest;
strikes;
supplier failures;
printing failures;
manufacturing failures;
material shortages;
power failures;
Internet failures;
cyberattacks;
carrier disruptions;
postal disruptions;
government actions;
customs actions;
epidemics;
pandemics; or
similar events beyond our reasonable control.
Such an event may delay performance without automatically creating a right to cancel a final-sale order.
41. ASSIGNMENT
You may not assign your contractual rights or obligations under these Terms to another person for the purpose of avoiding these Terms without our consent.
Stateless Books may assign or transfer its rights and obligations in connection with:
a sale of the business;
merger;
restructuring;
financing;
transfer of assets;
reorganization; or
successor operation of Stateless Books.
42. BUSINESS TRANSFERS
If Stateless Books is sold, merged, reorganized, financed, or transferred, customer accounts, order histories, contractual rights, publication permissions, and other business records may transfer with the business.
The purchaser or successor may assume the contractual rights associated with those records.
43. CHANGES TO THESE TERMS
We may revise these Terms as the business, website, products, or operating practices change.
The current Terms will be posted on statelessbooks.com with their effective date.
Changes apply prospectively to future use and transactions unless otherwise stated.
The terms governing a completed purchase are generally the terms you accepted in connection with that purchase.
If you do not agree with a revised version, stop using the site and do not place additional orders.
44. ENTIRE AGREEMENT
These Terms, our Privacy Policy, any applicable product-specific terms, and any other terms expressly incorporated into a transaction constitute the agreement between you and Stateless Books concerning that transaction.
Statements outside those materials do not modify the agreement unless Stateless Books expressly agrees to the modification.
A social-media comment, informal conversation, customer assumption, or statement by an unrelated third party does not rewrite these Terms.
